Terms of Service

The rules for using Tripycco as a traveller or a travel agency: bookings, payments, cancellations, reviews and responsibilities.

  • Tripycco connects you with independent travel agencies. The agency, not Tripycco, organises your trip and is responsible for it.
  • You pay the agency directly. Tripycco never takes payment and charges travellers nothing.
  • Refunds and cancellation conditions are the agency's, within the limits of consumer law.
  • Agencies must be licensed and verified before their trips go live, and must honour the bookings they accept.
  • Reviews must be honest and come from people who booked the trip.

1. About these terms

These Terms of Service (the "Terms") govern your use of the Tripycco website, the Tripycco mobile apps and the services provided through them (together, "Tripycco"). Tripycco is operated by EdbenDigital ("we", "us").

By creating an account or booking a trip, you accept these Terms. If you use Tripycco on behalf of a travel agency, you accept them for that agency and confirm that you are authorised to do so. Our Privacy Policy explains how we handle personal data and forms part of these Terms.

2. What Tripycco is

Tripycco is an online marketplace. Independent travel agencies ("Agencies") publish trips on it, and travellers ("Travellers") use it to discover those trips and reserve places on them.

  • Tripycco is not a travel agency and does not organise, sell or perform trips. Each trip is offered and carried out by the Agency named on its page.
  • When you book, the contract for the trip is formed between you and that Agency. Tripycco is not a party to it.
  • Tripycco does not collect or hold payments. You pay the Agency directly, by the means it offers.
  • Using Tripycco is free for Travellers.

We verify Agencies before their trips are published, but we do not inspect trips, accommodation or transport, and a verified status is not a guarantee of how a trip will be performed.

3. Your account

  • You must be at least 18 years old and able to enter into a binding contract to create an account.
  • The information you give must be accurate and kept up to date, in particular your name, email address and phone number, which Agencies use to reach you about your trip.
  • Your account is personal. Keep your password confidential and tell us promptly at [email protected] if you think someone else has used your account. You are responsible for activity on your account unless it results from our fault.
  • Agency accounts must be held by a person authorised to act for the Agency, and the Agency is responsible for everything done through them.

4. Booking a trip

Each trip page shows the information the Agency provides: the itinerary, dates, pickup points, what is and is not included, the number of places and the price. The Agency is responsible for that information being accurate, complete and lawful. Read it carefully before you book, and ask the Agency if anything is unclear.

  • A booking reserves the number of places you choose, on the dates and from the pickup point you select, for the price shown at the time of booking.
  • Prices are set by the Agency and shown in Moroccan dirhams (MAD) unless stated otherwise. Anything listed as not included, such as visas, personal expenses or optional activities, is extra.
  • Payment is arranged directly with the Agency. Ask it for a receipt or invoice, and do not send money to anyone who is not the Agency named on the trip.
  • If the booking details or payment status shown in your account look wrong, contact the Agency first, then us if it cannot be resolved.
  • The Agency may have its own booking conditions, such as deposits, deadlines or minimum group sizes. It must tell you about them before you pay, and they apply alongside these Terms.

5. Cancellations, changes and refunds

By you. You can cancel a booking from your account at any time before the departure date. Cancelling releases your places on Tripycco. Whether you are entitled to a refund of anything you have paid, and how much, depends on the Agency's cancellation conditions and on the consumer protection law that applies. Refunds are made by the Agency, not by Tripycco. Because trips are provided on specific dates, the statutory right of withdrawal for distance contracts generally does not apply to them.

By the Agency. An Agency may need to change or cancel a trip, for example because of safety concerns, too few participants or circumstances outside its control. It must tell you as soon as possible and offer you what the law and its conditions require, such as an equivalent alternative or a refund. We send a notification when an Agency changes or withdraws a trip you have booked, but the Agency remains responsible for informing you and putting things right.

Deleting your account. An unpaid upcoming booking is cancelled when you delete your account. If you have a paid trip coming up, you will need to settle it with the Agency first.

6. Before and during your trip

  • You are responsible for holding valid identity and travel documents, and any visa, permit, vaccination or health certificate your trip requires. This includes the specific requirements for Omra and Hajj. The Agency should tell you what is needed, and may help you obtain it.
  • We recommend that you take out suitable travel insurance.
  • Be at your pickup point on time. An Agency is not required to wait for, or refund, a traveller who misses the departure through their own fault.
  • Follow the Agency's reasonable instructions and the laws and customs of the places you visit. An Agency may exclude a traveller whose behaviour endangers or seriously disrupts others.
  • The details of the guests you book for must be accurate, and you must have their permission to share them with the Agency.

7. Additional terms for Agencies

If you use Tripycco as an Agency, you also agree that:

  • You hold, and will keep, every licence and authorisation your activity requires, including the travel agency licence required by Law No. 31-96 for agencies operating in Morocco, and any specific approval required for Omra and Hajj travel.
  • The documents and information you provide for verification are genuine and current. We may refuse, suspend or withdraw verification at any time, and unverified Agencies cannot publish trips.
  • Your listings are accurate, complete and not misleading, show the full price and what it covers, and comply with applicable law, including Law No. 31-08 on consumer protection. Photos and text you publish are your own or used with permission.
  • You honour the bookings you accept, perform trips as described, keep the bookings you record on Tripycco up to date, and respond to Travellers promptly.
  • You give Travellers your booking and cancellation conditions before they pay, issue receipts, and handle refunds and complaints in accordance with those conditions and the law.
  • You carry the insurance your activity requires, and you are solely responsible for the performance of your trips and for your suppliers, including hotels, carriers and guides.
  • You use Travellers' personal data only to organise and perform the trips they booked, as an independent data controller, and in accordance with Law No. 09-08 and any other data protection law that applies to you.
  • Any commercial terms, such as fees for using Tripycco, are those agreed in writing between you and us.

8. Reviews

Only Travellers who have booked a trip can review it. Reviews must reflect your own genuine experience. They are published with your name and profile picture.

  • Do not post reviews that are false, paid for, written in exchange for a benefit, or about a trip you have a business connection with.
  • Agencies must not review their own trips or competitors' trips, or pressure Travellers to change or remove a review.
  • Reviews must not contain insults, discriminatory remarks, personal data of others, or content that is unlawful.

We may remove a review that breaks these rules, and we do so without regard to whether it is positive or negative. Reviews express the opinions of their authors, not ours.

9. Acceptable use

When using Tripycco, you must not:

  • break the law, or use Tripycco for fraud, including fake bookings, fake listings or collecting payments for trips that will not take place;
  • impersonate anyone, or misrepresent your connection with a person or Agency;
  • upload content that is unlawful, offensive, infringes someone else's rights, or contains malicious code;
  • harass other users, or use contact details obtained through Tripycco for anything other than the booking concerned, including marketing that the person has not agreed to receive;
  • access Tripycco by automated means, scrape or copy its content at scale, or interfere with its security or operation;
  • try to access accounts or data that are not yours.

10. Content and intellectual property

Tripycco, its name, logo, design and software belong to us or our licensors and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable right to use Tripycco in accordance with these Terms.

You keep ownership of the content you upload, such as photos, trip descriptions, profile pictures and reviews. You grant us a non-exclusive, royalty-free, worldwide licence to host, reproduce, adapt for display and publish that content on Tripycco and in promoting Tripycco, for as long as it remains on Tripycco. You confirm that you have the rights needed to grant this licence.

11. Third-party services

Tripycco may let you message us through WhatsApp, and the apps are distributed through Google Play and the Apple App Store. Those services are provided by third parties under their own terms, and we are not responsible for them.

12. Availability and changes to the service

We work to keep Tripycco available and secure, but we do not guarantee that it will be uninterrupted or free of errors. We may carry out maintenance, and we may change, add or remove features. If we decide to close Tripycco, we will give reasonable notice so that Travellers and Agencies can make arrangements for upcoming trips.

13. Responsibility and liability

Nothing in these Terms excludes or limits any right you have as a consumer that cannot be excluded or limited by law, or our liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by our fault.

Subject to that:

  • Agencies are solely responsible for their trips, their listings and their conduct. Tripycco is not liable for the performance, cancellation or quality of a trip, or for any payment made to an Agency.
  • Tripycco is responsible for providing the platform with reasonable care and skill. We are not liable for losses that are not a foreseeable consequence of our breach, or for losses caused by events outside our reasonable control.
  • Where Tripycco is used by an Agency for business purposes, our total liability to that Agency is limited to the amounts it has paid us in the twelve months before the claim, and we are not liable to it for loss of profit, revenue, business or data.

14. Agency indemnity

An Agency will compensate us for claims, losses and reasonable costs, including legal fees, arising from its trips, its listings, its handling of Travellers' personal data, or its breach of these Terms or of the law.

15. Suspension, termination and deletion

You can stop using Tripycco at any time. Travellers can delete their account from their profile in the app or on the website. Agencies can close their account by writing to [email protected].

We may suspend or close an account, remove content or unpublish trips if a user seriously or repeatedly breaks these Terms, if we are required to by law, or to protect other users from fraud or harm. Except where this would compromise an investigation or safety, we will tell you the reason and give you the opportunity to respond. When we close an Agency account, we will try to ensure that Travellers with upcoming bookings are informed.

The sections that by their nature should continue after an account is closed, including sections 7, 10, 13, 14 and 17, continue to apply.

16. Changes to these terms

We may update these Terms to reflect changes in Tripycco or in the law. We will tell you about material changes in the app or on the website at least 15 days before they take effect, unless a change is required sooner by law or for security. If you do not agree to a change, you can delete your account before it takes effect. Bookings made before a change remain governed by the Terms that applied when they were made.

17. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Morocco. If you are a consumer living in another country, you also keep the protection of the mandatory rules of the law of that country.

If you have a complaint, please contact us first at [email protected]. We will acknowledge it and try to resolve it within 30 days. A dispute about a trip should first be raised with the Agency concerned, and we will help where we can.

If a dispute cannot be resolved amicably, it will be brought before the competent courts of Morocco. If you are a consumer, you may also bring it before the courts of your place of residence, and nothing in this section removes any right you have to do so.

18. General

  • These Terms, together with the Privacy Policy and any written agreement with an Agency, are the whole agreement between you and us about Tripycco.
  • If a provision is found invalid, the rest of the Terms remain in effect.
  • If we do not enforce a right straight away, we have not given it up.
  • You may not transfer your rights under these Terms without our consent. We may transfer ours to a company that takes over Tripycco, provided your rights are not reduced.
  • These Terms are available in English, French and Arabic, and each version has the same meaning. If they appear to differ, the interpretation most favourable to the consumer applies.
